Waiver of Liability
Your Physical Condition and Safety

1. You understand that it is your responsibility to consult a physician regarding your ability to participate in the physical activities involved in the Workshop and that participating in the physical activities undertaken on the Workshop imposes physical demands upon you.

2. You shall not participate in any of the physical activities on the Workshop whilst suffering from any infections or contagious illnesses, diseases or other ailments including but not limited to open cuts, abrasions, open sores or minor infections, where there is any risk that such use or participation in such conditions may be detrimental to the health, safety, comfort or physical conditions of other participants in the Workshop; you will bring any such matters to attention.

3. If you are pregnant, under medication and/or suffering from or have suffered from any medical disability, you are strongly advised to seek the advice of a qualified medical practitioner before commencing any of the physical activities on the Workshop.

4. No person who is under the influence of drugs or of alcohol is permitted on the Workshop.

5. You acknowledge and voluntarily assume (i) your responsibility to assess your level of fitness and general health (including, where appropriate, consulting your physician or doctor) and (ii) the risks of serious injury that are associated with physical activity of any kind including any variety of yoga, meditation and breathwork practice and participation in yoga-related activities or activities related to the Workshop (collectively the “Activities”). You confirm that you shall retain all control and direction over your Activities at all times. You voluntarily assume full liability and accept the risk of harm, including physical injury and discomfort as a result of your participation in the various Activities on the Workshop.

6. Only participants above the age of 18 is allowed to participate.

Limitation of Liability
1. You hereby acknowledge that you are aware that in participating in the physical activities available on the Workshop, and in using the facilities, there are risks or possibility of injury.

2. To the fullest extent permitted by applicable law, the instructor shall not be liable for any loss or damage to property or in respect of any bodily injuries, illness or death of you, howsoever caused, aggravated or incurred arising out of or in any way connected with your participation in the Workshop.

3. You hereby acknowledge that you understand and voluntarily accept the risks of injury involved in your participation in the Workshop. To the fullest extent permitted by applicable laws, you hereby agree the instructor shall not be liable in contract, tort (including without limitation negligence), pre-contract or other representations or otherwise out of or in connection with your participation in the Workshop, for any claims, demands, damages, economic loss (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), loss of good will or reputation, or special or indirect consequential losses in any case. You further agree not to hold the instructor liable for any wilful act or omission, default, fraud or negligence of any other person or guest or third party within the operated facilities.

4. You hereby agree to defend, fully indemnify on demand and hold harmless the Instructor from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis) which the instructor may suffer arising from any breach of these terms and conditions by you, or in connection with any act, omission, default, negligence or conduct of you in connection with any other liabilities arising out of you or any services under this Agreement. This obligation to indemnify instructor shall survive the termination of the Agreement.

Clauses

1. Fees

You are only entitled to attend the Event when you have paid the fees in full.

2. Your Physical Condition and Safety

You understand, agree and undertake that:

1. participating in the agreed Event imposes various types/levels of physical and mental demands and Risk of Injury and you must disclose to us any Existing Condition that you are aware of.;

2. Instructor is not trained and qualified medical professional and you shall not rely on any physical assessment by instructor as professional medical advice, or to use such assessment by instructor as the basis of any injury or health claim against instructor arising from the Event;

3. it is your ultimate responsibility to assess, and satisfy yourself, that you possess the fitness, skill and health levels adequate to safely undertake the Activities (including seeking professional medical assessment and advice yourself) and to use any Equipment;

4. you shall not perform any Activity if, in so far as you are aware, you possess an Existing Condition that could be aggravated or that could increase your Risk of Injury by your participation in the Activity;

2. You agree that our Representatives may refuse or discontinue your participation in the Event if they consider that an Existing Condition may be detrimental to your health or safety.

3. Assumption of Risk

   1. You acknowledge and agree that you, being fully aware of the Risk of Injury, you still intend to participate in the Event on an entirely voluntary basis and agree to assume full responsibility for all Risk of Injury arising out of or in connection with the Event.

4. Waiver and Release of Liability

   1. You waive and release all claims against us and all claims against each Protected Person, whether in contract, tort (including negligence) or otherwise, for any and all Loss you might incur arising out of or in connection with you participating in the Event;

   2. We do not exclude or limit in any way our liability to you where it would be unlawful for us to do so. This includes our liability for death or personal injury caused by our negligence or the negligence of our employees or agents or for fraud or fraudulent misrepresentation.

   3. We will not be liable to you for any indirect or consequential loss including loss of profit, loss of business, business interruption or loss of business opportunity.

5. Indemnity

   1. You agree to indemnify us and each Protected Person and hold us and each Protected Person harmless against all Loss we or they may suffer or incur, whether in contract, tort, negligence or otherwise, arising out of or in connection with any breach by you of this Agreement or your participation in the Event.

6. Recording of Event & Data Collection,

   1. You agree the Event can be recorded and stored by us in order to: (i) assess and improve your training or practice; (ii) evaluate and improve the Event; and (ii) for security reasons.

   2. All content provided by instructor are strictly intended for your individual use only and you must not record the Event for public or commercial use. You must obtain instructor’s prior consent if you wish to broadcast the recordings in a public forum or intend to use the recordings for a commercial purpose, and we may charge you a fee in respect of such use.

   3. We will collect and store the personal data you provide for the Event including the information in your application registration form, attendance and payments records, and other relevant information provided by you during or outside of the Event. This information is used for the purpose of managing your registration and payments, managing the provision of the Activities, our internal evaluation of the Event.

   4. The persona data we collect from you shall be kept confidential and will only be shared by third parties involved in the provision of the Event (such as contractors who provide administrative, technology, payment and/or other support services). Our recording of Event and collection of data from you will comply with applicable data protection laws and regulations.

   5. Providing personal data is optional but failure to provide the personal data requested we request may mean we are unable to process your application. You may seek access to and request correction of any personal data we hold about you by contacting the instructor.

7. Intellectual Property Rights

   1. All intellectual property used for the provision of the content belongs to instructor (including copyright, choreography, trademarks, logos, concept, and branding rights). This includes the intellectual property contained in materials provided to you outside of the event such as videos or other training materials. You agree that any intellectual property that is newly created during the event shall fully belong to instructor.

8. General Terms

   1. This Agreement is governed by the laws of Hong Kong.

   2. This Agreement is personal to you. You may not transfer your rights and/or obligations under this Agreement to anyone else.

   3. You agree that we may terminate this Agreement and your participation in the Event if you breach any Rules or if you engage in any behavior that prevents us from properly delivering the Event.

   4. This Agreement replaces and extinguishes all previous agreements between you and instructor whether written or oral, relating to the event. Where you have an existing Cardholder Agreement and/or other agreements with instructor these agreements shall still operate and in the event of any inconsistency relating to the Event this Agreement shall prevail).

   5. By signing this Agreement, you confirm that you have read, understood and agreed to all of its terms.
